Legal Realism Regained presents a comparison between the legal realists, a group of pragmatic legal theorists from the 1920s and 1930s, and critical legal studies, a movement of postmodern legal theory during the end of the twentieth century. The book argues for a return to legal realism and the classical pragmatism of John Dewey and William James and for a rejection of the postmodern critique of critical legal studies. It discusses the two movements with respect to three topics: their view (...) of history, their view of social science, and their view of language. Rejecting the claim that critical legal studies can be seen as the heir of legal realism, Legal Realism Regained argues that, with respect to each of these three topics, the realists still present a stronger argument than their more radical descendants. A growing number of jurisdictions hold that gamete donors must be identifiable to the children born with their eggs or sperm, on grounds that being able to know about one's genetic origins is a fundamental moral right. But the argument for that belief has not yet been adequately made.

A persistent controversy in language evolution research has been whether language emerged in the gestural-visual or in the vocal-auditory modality. A “dialectic” solution to this age-old debate has now been gaining ground: language was fully multimodal from the start and remains so to this day. In this paper, we show this solution to be too simplistic and outline a more specific theoretical proposal, which we designate as pantomime-first. To decide between the multimodal-first and pantomime-first alternatives, we review several (...) lines of interdisciplinary evidence and complement it with a cognitive-semiotic experiment. In the study, the participants saw – and then matched to hand-drawn images – recordings of short transitive events enacted by 4 actors in two conditions: visual and multimodal. Significantly, the matching accuracy was greater in the visual than the multimodal condition, though a follow-up experiment revealed that the emotional profiles of the events enacted in the multimodal condition could be reliably detected from the sound alone. We see these results as supporting the proposed pantomime-first scenario. (shrink)

At the heart of the Stoic theory of modality is a strict commitment to bivalence, even for future contingents. A commitment to both future truth and contingency has often been thought paradoxical. This paper argues that the Stoic retreat from necessity is successful. it maintains that the Stoics recognized three distinct senses of necessity and possibility: logical, metaphysical and providential. Logical necessity consists of truths that are knowable a priori. Metaphysical necessity consists of truths that are knowable a posteriori, (...) a world order according to certain metaphysical principles and natures that god crafts within the constraints of matter. Finally, what is providentially necessary is what occurs according to the chain of fate, but only once it is in process or past. -/- The method of the paper is a close reading of Diogenes Laertius 7.75, adducing broad textual evidence along the way, to show that the Stoic theory of modality embraces Philonian possibility, both that which is capable of being true as a matter of logical consistency, and that which is possible according to the bare fitness of the entity. What differentiates the Stoics from Philo is their additional commitment to possibility as opportunity, resisting the collapse of determinism into necessity. (shrink)

The global financial crisis has led to a surprising interest in professional oaths in business. Examples are the MBA Oath, the Economist’s Oath and the Dutch Banker’s Oath, which senior executives in the financial services industry in the Netherlands have been obliged to swear since 2010. This paper is among the first to consider oaths from the perspective of business ethics. A framework is presented for analysing oaths in terms of their form, their content and the specific contribution they (...) make to business ethics management: oaths may foster professionalism, facilitate moral deliberation and enhance compliance. This framework is used to analyse and evaluate the MBA Oath, the Economist’s Oath and the Banker’s Oath as well as various other similar initiatives. (shrink)

Open-content communities that focus on co-creation without requirements for entry have to face the issue of institutional trust in contributors. This research investigates the various ways in which these communities manage this issue. It is shown that communities of open-source software—continue to—rely mainly on hierarchy (reserving write-access for higher echelons), which substitutes (the need for) trust. Encyclopedic communities, though, largely avoid this solution. In the particular case of Wikipedia, which is confronted with persistent vandalism, another arrangement has been pioneered (...) instead. Trust (i.e. full write-access) is ‘backgrounded’ by means of a permanent mobilization of Wikipedians to monitor incoming edits. Computational approaches have been developed for the purpose, yielding both sophisticated monitoring tools that are used by human patrollers, and bots that operate autonomously. Measures of reputation are also under investigation within Wikipedia; their incorporation in monitoring efforts, as an indicator of the trustworthiness of editors, is envisaged. These collective monitoring efforts are interpreted as focusing on avoiding possible damage being inflicted on Wikipedian spaces, thereby being allowed to keep the discretionary powers of editing intact for all users. Further, the essential differences between backgrounding and substituting trust are elaborated. Finally it is argued that the Wikipedian monitoring of new edits, especially by its heavy reliance on computational tools, raises a number of moral questions that need to be answered urgently. This study aims to analyze what drives and prevents the purchasing of eco-friendly products across different consumer groups and develops a conceptual model embracing the positive altruistic, positive ego-centric, and negative ego-centric antecedents of eco-friendly product purchase intention and behavior. We empirically validate the conceptual model for green and non-green consumers. Data are analyzed using structural equation modeling and multi-group analysis of the two groups. The results confirm the relevance of the determining factors in the model and show significant differences (...) in eco-friendly product purchasing patterns between green and non-green consumers. Altruistic motives are more important for green than for non-green consumers. Negative ego-centric motives affect the purchase intentions of non-green consumers more than the intentions of green consumers, whereas the impact of negative motives on behavior is stronger for green than for non-green consumers. The first contribution of this paper is the development and testing of a parsimonious model of eco-friendly products purchasing that embraces both positive and negative antecedents, which have been theoretically suggested in the past but have rarely been empirically tested together. The second contribution of this study is that it develops insight into the specific antecedents of eco-friendly products purchasing for green and non-green consumers to assess potential similarities and differences in eco-friendly products purchasing process, the hypothesized antecedents, their impact on eco-friendly products purchase intention and behavior, and the intention–behavior relation. While most studies on stakeholder engagement focus on high-power stakeholders (typically, employees), limited attention has been devoted to the engagement of low-power stakeholders. These have been defined as vulnerable stakeholders for their low capacity to influence corporations. Our research is framed around the engagement of low-power stakeholders in the coffee industry who are, paradoxically, critical resource providers for the major roasters. Through the case study of Lavazza—the leading Italian roaster—we investigate empowerment actions addressed to smallholder farmers located in (...) Brazil, India, East Africa, Haiti, and the Dominican Republic. We contribute to the theoretical discussion around engagement and empowerment by developing a framework linking together areas of empowerment (defined in the literature) and specific empowerment actions (emerging from our interviews). Our insights shed light on how organizations can design empowerment strategies leading to more effective stakeholder engagement and how empowerment actions can contribute to turn low-power stakeholders into active business partners. We demonstrate that moving from a traditional competitive view of corporate–stakeholder relationships to a stakeholder theory view based on a logic of cooperative partnerships reinforces the idea that stakeholder engagement and empowerment are both entangled with the value creation process. The long standing reign of psychology as the privileged partner of education has, arguably, now been superseded by the neurosciences. Given that this helped to drive the emergent field of neuroeducation, it is crucial to ask what changes in education, if anything does in fact change, when the hitherto hegemonic psychologising discourse is substituted for a neurological one. The primary contention of this paper is that with the neuro-turn a process of “neurologisation” has also been initiated, which can (...) be analysed by taking into account its genealogical predecessor, psychologisation. In doing so, I argue, one ultimately discerns a primordial incompatibility between education and neuroscience, one that can be traced back to the fundamental and problematic reflexivity of modern subjectivity itself, which the discipline of psychology was never able to wholly resolve. From here, I proceed with the argument that while the eagerness of the psy-sciences to embrace neuroscience testifies to how much psychology needs neurology, the neurosciences are structurally incapable of disconnecting from the paradigms of the psy-sciences. Following on from this proposition, other strong/weak factors are brought into the equation: strong/weak nature, strong/weak culture, strong/weak subjectivity and, most pertinently, strong/weak education. Finally, the critical question becomes: if education in itself needs to take recourse to both the psy-sciences and the neurosciences, then how can we begin to account for the fact that these sciences invariably end up becoming captured within educational discourses themselves; that is, the fact that teachers, parents, and pupils themselves are taught the key insights of neuropsychology. Human communication can be either monosemiotic or polysemiotic, depending on whether it combines ensembles of representations from one or more semiotic systems such as language, gesture and depiction. Each semiotic system has its unique storytelling potentials, which makes intersemiotic translation from one system to another challenging. We investigated the influence of the source semiotic system, realised in speech and a sequence of pictures, respectively, on the way the same story was retold using speech and co-speech gestures. The story was the (...) content of the picture book Frog, Where Are You?. A group of Finnish speakers saw the story in pictures, and another group heard it in matched oral narration. Each participant retold the story to an addressee and all narrations were video-recorded and analysed for both speech and gestures. Given the high degree of iconicity in depiction, we expected more iconic gestures (especially enactments) in the narratives translated from pictures than in those translated from speech. Conversely, we expected greater narrative coherence in the narratives translated from speech. The results showed that more iconic gestures were produced in the narratives translated from speech, but these were primarily not from the enactment subtype. As expected, iconic enactments were more frequent in the narratives translated from the story presented in pictures. The narratives produced by participants who had only heard the story did not have a greater variety of connective devices, yet the type of devices differed slightly between the groups. Together with some additional differences between the groups that had not been anticipated, the results indicate that a story presented in different semiotic systems tends to be translated into different polysemiotic narratives. People more frequently select norm-violating factors, relative to norm-conforming ones, as the cause of some outcome. Until recently, this abnormal-selection effect has been studied using retrospective vignette-based paradigms. We use a novel set of video stimuli to investigate this effect for prospective causal judgments—that is, judgments about the cause of some future outcome. Four experiments show that people more frequently select norm-violating factors, relative to norm-conforming ones, as the cause of some future outcome. We show that the abnormal-selection effects (...) are not primarily explained by the perception of agency (Experiment 4). Moore′s paradox came of age when John N. Williams gave us a simple paradoxical argument according to which the Moorean believer must hold false belief while believing contingent propositions. Simplicity was key; it was groundbreaking for the topic. On Williams′s account, given only the notions of inconsistency and self‐refutation, the thesis that belief distributes over conjunction, and a tiny bit of classical logic, we can derive a paradox from the Moorean propositional schemata. But, as argued here, it′s easy to overestimate (...) the significance of his argument to a proper understanding of the problem. His fundamental claim can be established in a way that shows how the paradox arises for any propositional attitude that distributes over conjunction, which gives us the opportunity to reconsider the problem we have been calling “Moore′s paradox”, and to conclude that all of the available analyses of the problem are, at best, incomplete. On this new approach, we lose a little formal simplicity vis‐à‐vis Williams′s approach, but make conceptual economy, as we gain a farther‐reaching problem than the one we have known. (shrink)

Traditionally, Thomas S. Kuhn’s The Structure of Scientific Revolutions (1962) is largely identified with his analysis of the structure of scientific revolutions. Here, we contribute to a minority tradition in the Kuhn literature by interpreting the history of evolutionary biology through the prism of the entire historical developmental model of sciences that he elaborates in The Structure. This research not only reveals a certain match between this model and the history of evolutionary biology but, more importantly, also sheds new light (...) on several episodes in that history, and particularly on the publication of Charles Darwin’s On the Origin of Species (1859), the construction of the modern evolutionary synthesis, the chronic discontent with it, and the latest expression of that discontent, called the extended evolutionary synthesis. Most people's intuitive reaction after considering Nozick's experience machine thought-experiment seems to be just like his: we feel very little inclination to plug in to a virtual reality machine capable of providing us with pleasurable experiences. Many philosophers take this empirical fact as sufficient reason to believe that, more than pleasurable experiences, people care about “living in contact with reality.” Such claim, however, assumes that people's reaction to the experience machine thought-experiment is due to the fact that they value reality (...) over virtual experiences—an assumption that has seldom (if ever) been questioned. This paper challenges that very assumption. I report some experimental evidence suggesting that the intuition elicited by the thought-experiment may be explainable by the fact that people are averse to abandon the life they have been experiencing so far, regardless of whether such life is virtual or real. I use then an explanatory model, derived from what behavioral economists and psychologists call the status quo bias, to make sense of these results. Finally, I argue that since this explanation also accounts for people's reaction toward Nozick's thought-experiment, it would be wrong to take such intuition as evidence that people value being in touch with reality. With modern technological advances, distance education has become an increasingly important education delivery medium for, for example, the higher education provided by open universities. Among predictive factors of successful learning in distance education, the effects of non-cognitive skills are less explored. Grit, the dispositional tendency to sustain trait-level passion and long-term goals, has raised much research interest and gained importance for predicting academic achievement. The Grit Questionnaire, measuring Perseverance of Effort and Consistency of Interests, has been shown to be (...) a reliable instrument in traditional university student populations. However, the measurement and predictive validity of this questionnaire is still unknown for adult distance education university students who differ from traditional students in various ways. Based on a sample of 2,027 students from a distance education university, this study assessed the psychometric properties of the two-factor structure grit measured by the Grit Questionnaire. The findings suggest that the short form of the Grit Questionnaire is a potentially useful assessment tool for measuring the grit construct for distance learning higher education and that the Consistency of Interests factor is especially relevant to consider the improvement of learning performance for distance education in terms of courses credit and exam attempts. The measurement precision of the Perseverance of Effort factor, however, should be improved in future research to provide higher measurement accuracy and broader item coverage. (shrink)

Advanced practice nursing is an expanding field within many healthcare environments around the world. The scope and particular focus of an advanced practice nurse’s role is highly variable and thus the ethical challenges they face are equally diverse. Yet, the dominant existing ethics pedagogies used in the nursing context have been described as not fit-for-purpose. Existing pedagogies do not adequately prepare APN candidates to meet the ethical challenges they will encounter in practice. Applying an arts-based pedagogy in ethics education (...) for advanced practice nurses has the capacity to provide effective ethics learning. This article reports on the value of a multidisciplinary pedagogy used in a graduate course in nursing leadership, law and ethics for advanced practice at an Australian university. Written in a multidisciplinary mode that allies with the pedagogy it presents, it addresses the key pedagogical challenges and opportunities of teaching ethics through an innovative arts-based pedagogy centred upon the changing depictions of the human person in works of art housed in a major state-funded art gallery. Modern epistomology has been dominated by an empiricist theory of knowledge that assumes a direct individualistic relationship between the knowing subject and the object of knowledge. Truth is held to be universal, and non-individualistic social and cultural factors are considered sources of distortion of true knowledge. Since the late 1950s, this view has been challenged by a cognitive relativism asserting that what is true is socially conditioned. This volume examines the far-reaching implications of this development for the social (...) sciences. Recently, cognitive relativism has become a key issue of debate in anthropology, philosophy, and sociology. In anthropology this is illustrated by a growing awareness of the similarity of all systems of knowledge. In philosophy it is exemplified by the realization that traditional monolithic and absolutist concepts of truth have increasingly lost any power to make sense and to convince. In sociology it is visible in a renewal of interest in a general sociology of knowledge. Yet, in spite of this convergence of interests, practitioners of these three disciplines have on the whole shown no inclination to reach a consensus on the terms of reference that could facilitate an interdisciplinary approach. "Cognitive Relativism and Social Science "aims to do just this. It is a working assumption of this volume that, as far as the subject of cognitive relativism is concerned, anthropologists, philosophers, and sociologists should join forces rather than try to deal with the challenges of cognitive relativism within strictly imposed boundaries that normally separate academic disciplines. Only when they work together will it be possible to treat the problems posed by cognitive relativism in an adequate way. This volume provides the results of attempts to communicate on cognitve relativism across disciplinary boundaries. Many studies have argued for distinct but complementary contributions from each hemisphere in the control of movements to visual targets. Investigators have attempted to extend observations from patients with unilateral left- and right-hemisphere damage, to those using neurologically-intact participants, by assuming that each hand has privileged access to the contralateral hemisphere. Previous attempts to illustrate right hemispheric contributions to the control of aiming have focussed on increasing the spatial demands of an aiming task, to attenuate the typical right hand advantages, (...) to try to enhance a left hand reaction time advantage in right-handed participants. These early attempts have not been successful. The present study circumnavigates some of the theoretical and methodological difficulties of some of the earlier experiments, by using three different tasks linked directly to specialized functions of the right hemisphere: bisecting, the gap effect, and visuospatial localization. None of these tasks were effective in reducing the magnitude of left hand reaction time advantages in right handers. Results are discussed in terms of alternatives to right hemispheric functional explanations of the effect, the one-dimensional nature of our target arrays, power and precision given the size of the left hand RT effect, and the utility of examining the proportions of participants who show these effects, rather than exclusive reliance on measures of central tendency and their associated null hypothesis significance tests. The aim of the thesis is twofold. Firstly, it is argued that Frege's theory of meaning and denotation is the first successful non-psychologistic response to what has been called 'the puzzle of identity' and that, where Frege's theory differs most significantly from the theory of meaning and denotation developed by Russell in The Principles of Mathematics and in his unpublished manuscripts on logic of 1903-1905, Russell was right. Secondly, it is shown that Russell was again right when he claimed (...) that the central argument of 'On Denoting' completely discredits both his own and Frege's theory of meaning and denotation. An interpretation of the relevant passage of 'On Denoting' is put forward. The discussion makes evident that it is virtually impossible to disentangle that argument if one ignores his unpublished work on the topic. (shrink)

Communication with other life forms in our universe has been an ongoing effort most notably conducted by the Search for Extraterrestrial Intelligence Project (SETI). Whereas SETI uses a network of radio telescopes to search for frequencies that may indicate intelligent design, there are also attempts to communicate with extraterrestrials by using different ways to listen for messages as well as send messages. This article outlines a phenomenological approach that includes changes in cognition due to the creation of electronic sounds (...) mixed with stellar acoustics, radio frequencies, and natural and manmade sounds as a way of experiencing changes in cognitive states. These cognitive states may be related to a conscious contact with other life forms not from our world. In this sense it is a galactic approach to interspecies communication. (shrink)

We examine whether Thomsonian constitutivism, a metaethical view that analyses value in terms of ‘goodness-fixing kinds,’ i.e. kinds that themselves set the standards for being a good instance of the respective kind, offers a satisfactory explanation of value change and disagreement. While value disagreement has long been considered an important explanandum, we introduce value change as a closely related but distinct phenomenon of metaethical interest. We argue that constitutivism fails to explain both phenomena because of its commitment to goodness-fixing (...) kinds. Constitutivism explains away disagreement and at best explains the emergence of new values, not genuine change. Therefore, Thomsonian constitutivism is not a good fix for realist problems with explaining value disagreement, and value change. (shrink)

In addition the book will provide students with features integrated with study and learning approaches, TOK and the IB learner profile. Examples and activities drawn from around the world will encourage students to develop an international perspective.

In Switzerland, research with identifiable human tissue samples, and/or its accompanying data, must be approved by a research ethics committee before it can be allowed to take place. However, as the demand for such tissue has rapidly increased in recent years, and biobanks have been created to meet these needs, committees have had to deal with a growing number of such demands. Detailed instructions for evaluating every kind of tissue request are scarce. Committees charged with evaluating research protocols therefore (...) sometimes face uncertainty in their decision-making. We examine how a pool of Swiss REC members deal with a number of cases involving human tissue, in order to determine the standards they adhere to, and their understanding and implementation of existing laws and guidelines. There is considerable divergence in the approaches and decisions of Swiss REC members regarding human tissue sample requests, particularly concerning the issue of informed consent. Despite recent trends towards less strict consent requirements for biosample research, many of our respondents continue to employ demanding standards for researchers. The question of informed consent, and the circumstances in which it is required, continues to result in differences of opinion. While room for local and cultural interpretation is essential to the workings of an REC, misunderstanding of existing guidelines, or an absence of regulation in sensitive areas, will only lead to suboptimal functioning of the REC itself. Our data suggests that there is uncertainty and disagreement on the question of consent for human tissue sample, which existing laws and guidelines may not fully clarify. Methods to address these uncertainties should be implemented in order to ensure efficient and harmonious review of research protocols. (shrink)

The use of cross-media and transmedia-based art installation has generated new ways for the audience to appreciate, understand and experience art. Transmedia, the integration of multiple media forms to augment a single narrative, has not only been largely used in commercial films, but has also been used by artists to communicate their message more effectively. In this article, we explore some remarkable multi-channel video installations and transmedia artworks to highlight how this technology has shaped new uses of technology (...) as a new medium to express artistic concepts. We discuss one artwork, an experimental collaboration between artists and scientists, entitled Reefs on the Edge, which communicates valuable information about climate change to a general audience. The evolution and maintenance of cooperation in human and animal societies challenge various disciplines ranging from evolutionary biology to anthropology, social sciences, and economics. In social interactions, cooperators increase the welfare of the group at some cost to themselves whereas defectors attempt to free ride and neither provide benefits nor incur costs. The problem of cooperation becomes even more pronounced when increasing the number of interacting individuals. Punishment and voluntary participation have been identified as possible factors to support cooperation (...) and prevent cheating. Typically, punishment behavior is unable to gain a foothold in a population, while volunteering alone can efficiently prevent deadlocks in states of mutual defection but is unable to stabilize cooperation. The combined effects of the two mechanisms have surprisingly different consequences in finite and infinite populations. Here we provide a detailed comparison of the two scenarios and demonstrate that driven by the inherent stochasticity of finite populations, the possibility to abstain from social interactions plays a pivotal role, which paves the way for the establishment of cooperation and punishment. Deficits in the ability to read the emotions of others have been demonstrated in mental disorders, such as dissociation and schizophrenia, which involve a distorted sense of self. This study examined whether weakened self-referential source memory, being unable to remember whether a piece of information has been processed with reference to oneself, is linked to ineffective emotion recognition. In two samples from a college and community, we quantified the participants’ ability to remember the self-generated versus non-self-generated origins of (...) sentences they had previously read or partially generated. We also measured their ability to read others’ emotions accurately when viewing photos of people in affect-charged situations. Multinomial processing tree modelling was applied to obtain a measure of self-referential source memory that was not biased by non-mnemonic factors. Our first experiment with college participants revealed a positive correlation between correctly remembering the origins of sentences and accurately recognising the emotions of others. This correlation was successfully replicated in the second experiment with community participants. The current study offers evidence of a link between self-referential source memory and emotion recognition. (shrink)

The series of policy positions of the US administration in the opening years of the “biotech century” in respect to cloning, embryonic stem cell research, and the patenting of human embryos offers a case study in the development of public policy that, though it has been developed in the context of secular argument, reflects distinctive concerns of Christian theology. Through several events, the Bush administration has confronted a series of policy decisions affecting the ethical-legal framework for biotechnology. Though there (...) has been little explicitly Christian reflection within the bioethics community, Christians together with other thinkers have recognized that these questions could determine the scope and course of developments in biotechnology. Computer science advocates institutional frameworks as an effective tool for modelling policies and reasoning about their interplay. In practice, the rules or policies, of which the institutional framework consists, are often specified using a formal language, which allows for the full verification and validation of the framework (e.g. the consistency of policies) and the interplay between the policies and actors (e.g. violations). However, when modelling large-scale realistic systems, with numerous decision-making entities, scalability and complexity issues arise making it possible only (...) to verify certain portions of the problem without reducing the scale. In the social sciences, agent-based modelling is a popular tool for analysing how entities interact within a system and react to the system properties. Agent-based modelling allows the specification of complex decision-making entities and experimentation with large numbers of different parameter sets for these entities in order to explore their effects on overall system performance. In this paper we describe how to achieve the best of both worlds, namely verification of a formal specification combined with the testing of large-scale systems with numerous different actor configurations. Hence, we offer an approach that allows for reasoning about policies, policy making and their consequences on a more comprehensive level than has been possible to date. We present the institutional agent-based model methodology to combine institutional frameworks with agent-based simulations). We furthermore present J-InstAL, a prototypical implementation of this methodology using the InstAL institutional framework whose specifications can be translated into a computational model under the answer set semantics, and an agent-based simulation based on the jason tool. Using a simplified contract enforcement example, we demonstrate the functionalities of this prototype and show how it can help to assess an appropriate fine level in case of contract violations. The combined effect of coercion (public and private pressure), self-interest (competitive advantage) and conviction (intrinsically motivated or genuine) explain why environmental issues have become a key priority for companies. While research has explored coercion and competitive advantage, the role of conviction has received little attention. This paper aims to address this gap. Conviction, which has been correlated with institutional and individual drivers, offers more stable results and a potential multiplier effect as good examples are disseminated by imitation throughout an (...) industry. While the role of imitation has drawn increasing attention of business management studies, it has received scant attention in research on sustainability. This is the second gap this paper aims to address, contributing to the literature on sustainability in two ways: firstly, we will further explore the role of conviction in environmental sustainability; secondly, employing a compartmental model of epidemic propagation, used for other social phenomena, we model the role genuine examples by leaders can play within an industry and the dissemination of good behavior by imitation. Defining genuine conviction as the voluntary mitigation of the externalities of a firm's operations beyond that required by law or the market, substantiated in the responsible behavior of its leaders, our model discovers patterns that policymakers could use to create a “sustainability epidemic”. We suggest mathematical models of epidemics can be applied to sustainability, offering a fresh perspective on the phenomenon of imitation, allowing us to discover how some cultural and social habits can be used. In previous works, we presented a modification of the usual possible world semantics by introducing an independent temporal structure in each world and using accessibility functions to represent the relation among them. Different properties ofthe accessibility functions have been considered and axiomatic systems which define these properties have been given. Only a few ofthese systems have been proved tobe complete. The aim ofthis paper is to make a progress in the study ofcompleteness for functional systems. For this (...) end, we use indexes as names for temporal flows and give new proofs of completeness. Specifically, we focus our attention on the system which defines injectivity, because the system which defines this property without using indexes was proved to be incomplete in previous works. The only system considered which remains incomplete is the one which defines surjectivity, even ifwe consider a sequence ofnatural extensions ofthe previous one. (shrink)

Combining modalities has proven to have interesting applications and many approaches that combine time with other types of modalities have been developed. One of these approaches uses accessibility functions between flows of time to study the basic properties of the functions, such as being total or partial, injective, surjective, etc. The completeness of certain systems expressing many of these properties, with the exception of surjectivity, has been proven. In this paper we propose a language with nominals to denote (...) the initial and final sets of each function in a model in order to obtain a complete system for reasoning about surjective partial functions. For the past thirty years postmodernism has been the major philosophical trend. Starting as a potentially emancipatory tool, though, it has virtually resolved into an acceptance of any kind of position, in the name of a very politically correct relativism. The aim of this essay is to provide an overview of New Realism in its opposition and reaction to Postmodernism, showing that it does not imply a return to a ‘traditional’ or ‘strong’ realism but that, on the contrary, it (...) involves a kind of ‘weak realism’: a blend between realism and constructivism. An analysis of the implications of both philosophical approaches in diverse fields will be offered, from epistemology, to politics, to ethics. Where postmodern epistemological claims will be proved to be quite easily confutable, its ethical implications will be faced more carefully. Ethical new realism will, therefore, be presented as particularly challenging, but also promising and important to the future of philosophy. (shrink)

Nowadays, on national and international levels, the law has been increasingly considering local and traditional communities’ role for achieving conservation. In Brazil, for instance, one can see how recent legal rules promote benefits for those local groups who practice low environmental impact activities. Nevertheless, regarding traditional fishing communities that live on the coastal zone, a region where many protected areas have been created lately in Brazil, the positive social effects of those measures are often undermined by the economic (...) and political pressure they suffer. This becomes particularly clear when the problem is seen under the different grades of citizenship people face in Brazil: that is, considering how people can be over-included in the legal system to have mainly access to its benefits, while others are under-included to be mainly dependent on it. It seems that Brazilian coastal fishing communities fall into the latter case, and that would explain how they are subject to many different types of restrictions and responsibilities due to the new legal instruments that are being developed to protect such areas, sometimes causing, for instance, a pressure to remove them from their homes. Conservation in this context, then, is to be understood beyond legal texts and, especially, under the evaluation of the social conditions these populations are submitted to. Therefore, this paper sketches the legal development of Brazilian marine protected areas, points out some examples of conflicts involving traditional fishing communities affected by conservation policies, and conceptualizes the relations of over- and under-inclusion they can be considered as part of. We are living in an age of crisis—or an age in which everything is labeled a crisis. Financial, debt, and refugee “crises” have erupted. The word has also been applied to the Arab Spring and its aftermath, Brexit, the 2016 U.S. election, and many other international events. Yet the term has contradictory political and strategic meanings for those challenging power structures and those seeking to preserve them. For critics of the status quo, can the rhetoric of crisis be used (...) to foment urgency around issues like climate change and financialization, or does framing a situation as a “crisis” play into the hands of the existing political order, which then seeks to tighten the leash by creating a state of emergency? Critical Theory at a Crossroads presents conversations with prominent theorists about the crises that have marked the past years, the protest movements that have risen up in response, and the use of the term in political discourse. Tariq Ali, Rosi Braidotti, Wendy Brown, Maurizio Lazzarato, Angela McRobbie, Jean-Luc Nancy, Antonio Negri, Jacques Rancière, Saskia Sassen, and Joseph Vogl offer their views on contemporary challenges and how we might address them, candidly discussing the alternatives that new social movements have offered, alongside an exchange between Zygmunt Bauman and Roberto Esposito on theories of community. Sparring over crucial developments in these past years of catastrophe and the calamity of everyday life under capitalism, they shed light on how crises and the discourse of crisis can both obscure and reveal fundamental aspects of modern societies. Current developments in biomedicine are presenting us with difficult ethical decisions and raising complex policy questions about how to regulate these new developments. Particularly vexing for governments have been issues related to human embryo experimentation. Because some of the most promising biomedical developments, such as stem cell research and nuclear somatic transfer, involve such experimentation, several international bodies have drafted documents aimed to provide guidance to governments when developing biomedical science policy. Here I focus on two such documents: the (...) Council of Europe's Convention for the Protection of Human Rights and Dignity of the Human Being and the Additional Protocol to the Convention for the Protection of Human Rights and Dignity of the Human Being.I argue that by using human dignity as a criterion to determine the permissibility of particular human embryo research practices, these documents cannot aid in identifying research that would be contrary to human dignity. Thus, they fail to guide public policy on embryo experimentation. Their use of human dignity as a criterion makes their task of offering guidance unfeasible because the concept as used in these documents is too vague and is applied in contradictory ways. I discuss the main goals of these documents and their claims in relation to human embryo research. I then discuss how they have influenced public policy in several countries. Finally, I show that although these Council of Europe treaties attempt to serve as public policy guides in the area of embryo research, they fail to do so. (shrink)

Pierre Teilhard de Chardin, jésuite et paléontologue, est surtout connu pour ses idées peu orthodoxes, au travers desquelles il tenta de concilier la science évolutionniste avec ses théories spirituelles personnelles. En dépit de la censure de la part des autorités ecclésiastiques, Teilhard essaya d’élaborer cette conciliation et de la disséminer dans les milieux intellectuels catholiques. Pour mener à bien ces deux projets, il trouva du soutien dans les cercles évolutionnistes de l’Université Catholique de Louvain et la maison jésuite de la (...) même ville belge. Le réseau louvaniste de Teilhard agit comme un amplificateur important de ses idées et lui offrit une aide concrète pour répandre celles-ci et pour éviter la censure. Malgré leur influence mutuelle significative, des divergences d’ordre philosophique entre Teilhard et ses amis louvanistes demeurèrent pourtant, et finirent par les séparer. Pendant les années 1930, le réseau louvaniste de Teilhard fut dissous en grande partie. Ses actions ne restèrent pourtant pas sans résultat. Ce petit groupe d’intellectuels fit sans aucun doute évoluer le climat en faveur de l’évolutionnisme au sein des milieux catholiques, et prépara, de cette manière, le succès des idées teilhardiennes à la suite de la Seconde Guerre mondiale. The Jesuit and palaeontologist Pierre Teilhard de Chardin is basically known for his not always orthodox conceptions by which he tried to reconcile evolutionist science with his personal spiritual ideas. In spite of censorship from the ecclesiastical authorities, Teilhard attempted to elaborate this conciliation and to spread it among catholic intellectuals. For both of these projects he found crucial support in evolutionist circles at the Catholic University of Louvain and the Jesuit house in the same Belgian town. Teilhard’s Louvain network proved to be an important sounding board and it offered concrete help in spreading his ideas and in bypassing the censorship. Despite significant mutual influences, philosophical divergences between Teilhard and his Louvain friends remained, and would eventually drive them apart. Therefore, in the 1930s, Teilhard’s Louvain network largely dissolved. However, its actions had not been without result. This small group of intellectuals definitely changed the climate among Catholics in favour of evolutionism and thus prepared the success that Teilhardian ideas would have in the aftermath of the Second World War. Ungeachtet der Zensur durch die kirchlichen Autoritäten bemühte sich Teilhard um die Ausarbeitung dieser Versöhnung und um ihre Verbreitung in den katholischen Intellektuellenmilieus. Bei der Verwirklichung dieser beiden Projekte fand er Hilfe in den evolutionistischen Kreisen der Katholischen Universität Löwen und bei der Jesuitengemeinschaft derselben Stadt. Das Löwener Netzwerk half ihm dabei, seine Ideen einem größeren Publikum zugänglich zu machen, und lieferte konkrete Unterstützung bei der Verbreitung der Thesen und bei der Umgehung der Zensur. Trotz ihrer bedeutenden gegenseitigen Beeinflussung bestanden jedoch auch weiterhin philosophische Divergenzen zwischen Teilhard und seinen Löwener Freunden, die schließlich zur Trennung führten. In den 30er Jahren wurde der Löwener Kreis um Teilhard größtenteils aufgelöst. Sein Handeln blieb jedoch nicht ohne Resultat. Diese kleine Gruppe Intellektueller hat mit Sicherheit dazu beigetragen, das Klima zugunsten der Evolutionstheorien innerhalb der katholischen Kreise zu verbessern und bereitete auf diese Weise den Weg für den Erfolg der teilhardschen Ideen nach dem Zweiten Weltkrieg. Recent experimental research has revealed surprising patterns in people's intuitions about free will and moral responsibility. One limitation of this research, however, is that it has been conducted exclusively on people from Western cultures. The present paper extends previous research by presenting a cross-cultural study examining intuitions about free will and moral responsibility in subjects from the United States, Hong Kong, India and Colombia. The results revealed a striking degree of cross-cultural convergence. In all four cultural groups, the majority (...) of participants said that (a) our universe is indeterministic and (b) moral responsibility is not compatible with determinism. (shrink)

Herman Dooyeweerd ( 1985 ) argued that among the modalities making up the fabric of reality a specifically economic one is to be found. The aim of the present paper is to discuss the texture of such a modality and how it both differentiates and intertwines with others. For an updated brief, albeit cogent and analytically lucid presentation of the Law Framework ontology, see Clouser ( 2009 ). Dooyeweerd’s view entails that the proper object of economics is irreducible to that (...) of other disciplines, but a non-reductionist view of the object of economics presupposes that the nuclear meaning of that discipline has been clearly delimited: this is required in order to determine its nature and separate identity as a scientific discipline. By ‘the nuclear meaning of a discipline’ I understand a pre-theoretical delimitation of its field of research, such as that of the field of physics, characterized by the laws governing force and energy. Within one and the same field there may be many theories, theories competing to explain the same phenomena, or dealing with phenomena so different that it is nearly impossible to trace conceptual connections among them. This last situation calls for a unified-field theory. In the second section of this paper I will attempt to defend a rather commonly accepted definition of the field of economics that sees this discipline as a science of choice. In the third I will show how the analytical conception it involves can be naturally complemented with a classificatory one. According to a classificatory conception, the aggregated social-level phenomena, patterns and regularities economic theories usually deal with, are economic in that sense, even though they are not prima facie cases of individual behavior, or are unintended consequences of aggregated individual choices. In the fourth I will discuss the meaning of the most general, supra-arbitrary economic laws—the modal laws of economics. In the final section I will offer a non-reductionist view of economics that nevertheless takes into account its intertwining with other spheres. (shrink)

The dramatic appearance of managed care organizations (MCOs) on the U.S. health scene has generated tremendous anxiety among health care providers and patients. These fears are based on the belief that managed care techniques pose greater risks of under treatment than do fee-for-service modes of payment. In addition, many physicians and patients resent the limits placed on clinical autonomy by the MCO model and the stresses that it places on the traditional physician-patient relationship. These misgivings have been exacerbated by (...) the mostly negative response to MCOs in the media and academia. Legislatures have responded to these claims and public fears with a wave of regulatory initiatives. Some of these regulations are attempts to protect patients. Others, however, are motivated primarily by antipathy toward the concept of managed care itself. This essay is an attempt to develop a social ethic of regulation and argues that the sole reason that private enterprise may be justifiably limited is when it presents a risk of harm to others or society. While some regulation and proposed regulation of MCOs meet this standard, much legislation represents an unjustified attempt to limit or handicap otherwise legal behavior merely because a segment of the population and medical profession find it aesthetically unpleasing and oppose its approach to the delivery of health services. “Letters to Two Friends describes the author’s daily life and the development of his thought, and constitutes a kind of ‘journal’ – a journal extending from1926 to1952, throughout almost all of Father Teilhard’s life as a scientist and a priest. The letters come from Peking, Paris and Rome. They mark Father Teilhard’s periodic exile and yet permit us to follow the story of his inner life almost month by month. The spontaneity of his tone and the depth and quality of (...) his feelings and thoughts make these letters a unique document. The first letters date from 1926, when Father Teilhard left his professorship at the Catholic Institute in Paris to lead the life of an explorer in the Far East. This period was one of the most difficult of his life. ‘I would prefer Tientsin to the Catholic Institute’, he wrote to a friend when he embarked for China in 1923. But his second departure in 1926 had something of the aspect of a disgrace. He had been removed from Paris by his superiors, to whom he had been denounced for propagating dubious ideas and who feared a censure that would be prejudicial both to the career of the young palaeontologist and to the good name of the Order. Father Teilhard obeyed in a spirit of faith, but without compromising his principles. A profound change subsequently took place in his scientific vision of the world. Until then passionately interested in the study of prehistory, he now lost his taste for the past. He doubted both his religious vocations and his scientific calling. One of the arresting elements of this collection is its juxtaposition of the social upheavals of our epoch with the story of a man’s steady spiritual growth. Father Teilhard gives a sharply focused picture of the world in which he lives, whether it can be China in the midst of civil war or the France of the thirties under the threat of approaching war, and at the same time portrays the evolution of his inner world, which found final expression in The Phenomenon of Man and The Divine Milieu. Father Teilhard’s allegiance to his Church and to his Order are reflected in these letters. The Florilegium Coislinianum, from which we are editing the chapter dealing with words beginning with the letter ?, is a large Byzantine anthology, dating back to the 9th-10th cent. Its manuscript tradition has been exhaustively explored for the first time in this article and our edition is based on 11 manuscripts, dated from the 10th to the 14th cent. We also compared the Florilegium Coislinianum with the Sacra Parallela and the Loci Communes.
